That would certainly apply in these circumstances.  The prosecutor over reached and then couldn't make a case beyond reasonable murder for capital murder. 

The bitch got away with killing her child thanks to poor prosecution by an inept prosecutor.


    I think that jury would have found her not guilty no matter what!  They seemed to have had thier heads up thier butts and were looking for an excuse to say not guilty!  Thier were other charges they could have very easily beyond any doubt said guilty to. At least I don't see how thier could be even a shawdow of a shawdow that She was guilty of Child abuse at the very least!  When a Woman go's out and parties while her young child is missing thats child abuse in my book!
